NH man accused of causing death of 19-month-old stepson pleads not guilty
HAMPTON — A stepfather who was accused of recklessly causing the death of his 19-month-old stepson has pleaded not guilty to multiple charges.
The stepfather, Leo Witham, 31 of Hampton, filed the plea in Rockingham Superior Court after waiving his arraignment, according to Seacoastonline. He was indicted on one count each of manslaughter and negligent homicide earlier this month after the boy passed away in October.
Both charges allege that Witham left fentanyl accessible to his stepson.
Witham was previously indicted in January on two counts of endangering the welfare of child, one count of falsifying physical evidence and one count of possession of a controlled drug. He was arrested October 7 in connection with the death.
Witham is currently being held on $50,000 cash surety bail at the Rockingham County House of Corrections. He could face 15 to 30 years in prison if convicted of either charge.
