Ex-sheriff's deputy convicted of raping inmate delays 2nd trial
LACONIA — The jury selection for former Belknap County Sheriff's deputy, Ernest Justin Blanchette, will likely not begin until June 13.
This is because Blanchette's attorney, Brad Davis, is trying to raise a legal point to the New Hampshire Supreme Court that could delay his client's trial by up to a year, the Union Leader reported.
He has already been convicted and sentenced in Manchester, but Davis is claiming that prosecutors have to prove that he was an employee of the state at the time of the sexual contact with an inmate.
Blanchette faces nine counts of aggravated felony-level sexual assault and one count of felony-level sexual assault.
He was sentenced in Manchester on Friday to serve 10 to 20 years in prison with two years of the minimum sentence to be reduced if he completes a sex offender program.
